Terms of Service
These Terms govern your use of Wearable/IM. By creating an account, opening a channel, or placing an order, you agree to them.
1. The platform
Wearable/IM is a marketplace for community-owned merchandise. We provide the storefront, payment processing (via Stripe and PayPal), and connect every order to a print-on-demand fulfilment partner. Production, shipping, and customer support for fulfilment are handled by the partner; everything else (catalogue, payments, account, communication) is on us.
2. Accounts
- You must be at least 16 to create an account.
- You are responsible for keeping your login credentials safe and for everything that happens under your account.
- One person, one account. Don't impersonate someone else.
3. Channels and content
You retain all rights to the artwork and copy you upload. By dropping an item you grant Wearable/IM a non-exclusive, worldwide licence to display, reproduce, and print it for the sole purpose of fulfilling orders and promoting the platform.
You promise that anything you upload is yours, in the public domain, or used with permission. We will remove items that infringe a third party's rights — see our DMCA / takedown procedure on the contact page.
3a. Channel owners are responsible for what they drop
Wearable/IM provides the storefront, payment processing, and print-on-demand fulfilment pipeline. We do NOT pre-screen, edit, or curate the artwork, descriptions, tags, or any other content channel owners drop on the platform.
The channel owner is solely responsible for the legality, accuracy, and rights status of everything they publish — including artwork, photography, text, trademarks, third-party imagery, slogans, references to people or brands, and any claims made in product descriptions. This responsibility includes (without limitation) intellectual-property infringement, defamation, hate speech, illegal content, false advertising, and breach of personality or publicity rights.
Wearable/IM is not the author, publisher, or co-creator of channel content for the purposes of liability assessment. To the maximum extent permitted by applicable law, we disclaim liability for losses, damages, claims, regulatory fines, or third-party actions arising from content posted by a channel owner. Where law mandates platform takedown duties (e.g. § 10 TMG, EU Digital Services Act, DMCA), we act on properly-formed notices — see the contact page for the takedown procedure.
Channel owners agree to indemnify Wearable/IM against third-party claims arising from their content. For verification, dispute, and law-enforcement requests, Wearable/IM may be required by law to share the channel owner's identifying information (legal name, address, contact details, payout data) that they provided as part of the payout flow.
4. Orders and payments
- Prices include the platform fee but exclude taxes and shipping.
- Your card is charged at the moment you complete checkout.
- Stripe and PayPal handle the card data — Wearable/IM never sees it.
- Once an order has been forwarded to print, it can no longer be cancelled (see Refund & Returns).
5. Acceptable use
You may not use Wearable/IM to:
- publish hate speech, harassment, or violence-glorifying content;
- upload sexually explicit material involving minors;
- scrape, reverse-engineer, or interfere with the service;
- resell platform features as if they were your own.
6. Termination
We may suspend or remove a channel that breaks these Terms. Pending payouts for fulfilled orders are still paid out. Open orders are refunded.
7. Liability
To the extent permitted by law, Wearable/IM is provided "as is". We are not liable for indirect damages or for loss of profits arising from use of the platform. Statutory consumer rights are unaffected.
8. Changes
We may update these Terms — material changes will be announced by email and on the home feed at least 14 days before they take effect.
9. Governing law
These Terms are governed by the laws of Germany. The exclusive forum is the courts of Berlin where the law allows it.
